Childhood lost: Understanding juvenile sex offenders

Abstract:

Sexual abuse is one of the most common and disruptive crimes in India. It is a highly complex crime and has multiple effects on the victim, the offenders, and their families. Given its deep impacts, it is essential to reduce its occurrence for which there is an urgent need to study its various nuances. 
A significant aspect of the crime is the profile and psyche of the offender- with growing incidents of minor offenders being observed. India, like many other countries, is grappling with the complexities of juvenile crime, which, in its most severe form, includes sexual offenses (1). In Indian society, where cultural, social, and legal frameworks are still evolving to address such issues, the cases involving juveniles committing sexual offenses raise pertinent questions about the intersection of childhood, criminality, and justice.
Sexual offenses by juveniles are a grave concern due to their potentially long-lasting consequences not only for the victim and the offender, but on society and the nation at large. This essay attempts to analyze the statute regarding juvenile sex offenders in India, the statistics available regarding such crimes, psychological and social reasons for their perpetration, the impacts of the crime, and to suggest solutions to reduce the occurrences of such offenses as well as ease rehabilitation and reintegration of the offenders. Additionally, it will also examine the issue of consensual sex between minors in the age group of 15-18, and conclude with a feminist perspective on the issue.
